These Terms and Conditions (“Terms”) govern the provision of therapy services (“Services”) offered by Mustard Seeds Therapy, LLC, having its principal place of business at Mustard Seeds Therapy (“We,” “Us,” or “Our”). The Services include Applied Behavior Analysis (ABA), Occupational Therapy, Speech Therapy, and Physical Therapy, which may be provided in-clinic, in-home, or through teletherapy sessions, as well as through our website www.mustardseedstherapy.com (the “Website”).

By accessing or utilizing Our Services, whether through in-person sessions, teletherapy, telephone inquiries, or via the Website, you (“Client,” “You,” or “Your”) agree to be bound by these Terms. These Terms form a legally binding agreement between You and Mustard Seeds Therapy. If you do not agree to these Terms, you must immediately stop using Our Services and Website.

Changes to Terms

  1. Mustard Seeds Therapy reserves the right to modify, update, or amend these Terms at any time without prior notice. Any changes will be effective immediately upon posting on Our Website, and your continued use of the Services or Website constitutes acceptance of the revised Terms.

  2. Where possible, we will notify You of material changes, either by placing a notice on our Website or through direct communication.

Services

Mustard Seeds Therapy provides professional therapy services designed to support developmental, behavioral, and physical well-being (the “Services”). These include, but are not limited to:

  • Occupational Therapy: Therapy aimed at improving daily living skills, sensory regulation, and fine motor development.
  • Speech Therapy: Services focused on communication, language, and feeding skills.

  • Physical Therapy: Exercises and interventions to improve mobility, strength, and physical development.

  • Teletherapy: Therapy delivered through secure online platforms for families who choose or require virtual care.

Services are provided in a professional and ethical manner, in compliance with applicable laws and professional standards. Services are available only in the states of Nevada and California.

Client Responsibilities

As a Client of Mustard Seeds Therapy, you agree to:

  1. Accurate Disclosure: Provide complete and truthful information about your child’s health, history, and needs, and update us promptly if changes occur.

  2. Compliance with Therapy Plan: Follow the recommended therapy plan, attend scheduled sessions, and encourage at-home strategies if provided.

  3. Timely Communication: Notify us immediately of any issues, concerns, or unexpected changes in your child’s condition.

  4. Appointment Management: Attend appointments on time. Notify us at least 24 hours in advance if you need to cancel or reschedule. Repeated no-shows may result in suspension of Services.

  5. Health and Safety: Follow safety instructions given by therapists during sessions, including teletherapy requirements for a safe and quiet environment.

  6. Appropriate Conduct: Treat our staff and other clients with respect. Abusive or inappropriate behavior may result in termination of Services.

  7. Medical Advice and Referrals: Acknowledge that while we provide therapy services, we do not replace medical providers. Follow through on referrals or recommendations made by our staff when additional care is necessary.

Booking, Referrals, and Appointments

  1. Referral Process:

    • A downloadable referral form is available on our Website.

    • Completed forms may be submitted by Fax, Email, or Mail.

    • Referrals can also be made directly by calling our office.

  2. Appointment Scheduling:

    • Appointments may be booked by phone, fax, email, or through the Website contact form.

    • All information provided at booking must be accurate.

  3. Cancellations and Rescheduling:

    • Clients must provide at least 24 hours’ notice for cancellations or rescheduling.

    • No-shows without notice may result in suspension of Services.

  4. Cancellations by Mustard Seeds Therapy:

    • We may cancel or reschedule appointments due to illness, emergencies, or operational needs.

    • If this occurs, we will notify you as soon as possible and reschedule at no additional cost.

Disclaimer

Our Services are intended to support developmental, behavioral, and physical health. They are not a substitute for medical diagnosis, treatment, or emergency care. While therapy is designed to promote progress, outcomes vary based on individual circumstances. Mustard Seeds Therapy cannot guarantee specific results.

Limited Liability

We provide Services with reasonable skill and care. However, to the maximum extent permitted by law, Mustard Seeds Therapy will not be liable for indirect, incidental, or consequential damages, including lost opportunities or delays in progress. Our total liability to You for any claim related to our Services shall be limited to the value of the Service provided in the specific case.

Indemnity

You agree to indemnify and hold harmless Mustard Seeds Therapy, its employees, and affiliates from any claims, damages, or expenses arising from your breach of these Terms or misuse of the Services.

Confidentiality

We are committed to protecting your privacy. All information shared with Mustard Seeds Therapy will remain confidential, except where disclosure is required by law or professional duty.

Data Protection

Mustard Seeds Therapy complies with all applicable U.S. data protection laws, including HIPAA.

  • Client information is used only for the provision of Services.

  • Records are stored securely and retained only as long as legally required.

  • Clients may request access, corrections, or deletion of personal data, subject to legal and professional obligations.

Intellectual Property

All Website content, including text, graphics, and resources, belongs to Mustard Seeds Therapy. No materials may be copied, reproduced, or distributed without prior written consent.

Force Majeure

Mustard Seeds Therapy is not liable for delays or failures to provide Services caused by events outside of our control, including but not limited to natural disasters, pandemics, or government restrictions.

Termination of Services

Services may be terminated if:

  • A client breaches these Terms,

  • Repeated no-shows occur,

  • Inappropriate behavior is displayed, or

  • Therapy is no longer clinically appropriate.

Dispute Resolution

If a dispute arises, both parties agree to attempt informal resolution first. If resolution is not possible, disputes will be handled through binding arbitration under the laws of Nevada and California. The arbitrator’s decision will be final and binding.

Governing Law

These Terms and Conditions are governed by and interpreted in accordance with the laws of Nevada and California, depending on the location of Services provided.
